Define the treatment opportunity being questioned
“Failure to treat” is too broad to evaluate without a specific decision. Identify the diagnosed or suspected condition, the treatment or monitoring allegedly indicated, what was actually offered or performed, and the medical reason documented for the chosen plan.
Documents that can explain the plan
- Assessment and plan notes
- Orders, prescriptions, and procedure recommendations
- Consultation and follow-up records
- Consent, refusal, or shared-decision documentation when relevant
- Later records showing deterioration or added treatment
Questions to separate negligence from a reasonable treatment choice
- Were there multiple medically accepted options?
- Was the patient able to receive the proposed treatment?
- Did new information require the plan to change?
- Would the alleged omitted treatment probably have prevented or reduced the injury?
