An incident report may be different from the medical chart
Hospitals and facilities may use internal safety or event-reporting systems. Whether a particular report exists, can be obtained, or is protected from disclosure can depend on the jurisdiction and circumstances.
Do not assume “incident report” means an admission of fault
An event report may document that something unusual occurred or was reviewed. It does not by itself establish the legal standard of care, causation, or liability.
What to identify
- Date and type of event
- Whether the medical chart refers to an event or safety review
- Names of staff involved in the clinical care
- Any related risk-management or patient-relations correspondence actually provided to you
- State-law questions about discoverability to ask counsel
