Witness Notes for Medical Malpractice

Witness notes are most useful when they preserve firsthand observations

Write down what the person personally saw, heard, or did, along with the approximate date, location, and people present. Avoid turning a witness note into a medical conclusion or legal argument.

What to capture

• Identity and contact information of the witness
• Where the witness was and why
• Words or events remembered directly
• Approximate time and sequence
• Documents, messages, or photographs that support the memory

Preserve memory without editing history

Keep the original dated note. If the witness later remembers something else, add a separate dated supplement rather than silently rewriting the first version.

What witness notes cannot establish by themselves

A witness can describe observations but generally cannot replace medical records or qualified expert analysis of standard of care and causation.
