Medical negligence focuses on conduct, not simply a bad result
A negligence analysis asks what professional duty applied, what the provider did with the information available at the time, and whether that conduct fell below the legally relevant standard. A complication or unsuccessful treatment can occur without negligence.
Define the exact medical decision
- Diagnosis or differential diagnosis
- Test ordering or interpretation
- Treatment or procedure selection
- Monitoring and response to change
- Referral, follow-up, discharge, or communication
Then keep breach separate from causation
Showing a questionable decision and showing that it caused compensable injury are separate tasks. Records and qualified expert testimony may be needed for both.
Check current law before relying on a procedural rule
Medical-malpractice filing rules differ by state and can change. Use the relevant court, legislature, medical-board, and lawyer-licensing sources, and ask licensed counsel to calculate deadlines or filing requirements for a specific matter.
