Fertility-loss claims need precise medical causation
Identify the organ, procedure, infection, medication, treatment delay, or other event alleged to have affected fertility. Later difficulty conceiving does not by itself establish that earlier care caused infertility.
Records that may establish the before-and-after picture
- Prior reproductive and gynecologic or urologic history
- Operative and pathology reports
- Infection, medication, oncology, or other treatment records when relevant
- Post-event fertility evaluation
- Specialist recommendations and assisted-reproduction records if obtained
Questions for an expert
- What was the person's baseline fertility status?
- What mechanism is alleged to have caused the loss?
- Are there other medical explanations?
- What future reproductive treatment is documented as medically appropriate?
